1. Platform Overview

Birthday VIP Club™ is a promotional restaurant marketplace designed to connect consumers celebrating birthdays with participating restaurant offers. The platform operates through structured promotional cycles, redemption limits, and rotational visibility to ensure fair exposure among restaurant partners.

By using this website or platform, you agree to these Terms of Service.

2. Pre-Launch Phase and Geographic Availability

Birthday VIP Club™ currently operates in a Pre-Launch Phase limited to Staten Island, New York. During this phase, consumers will only see and receive offers from participating Staten Island restaurants.

As the platform expands, additional Selection Phases may be introduced in new cities, boroughs, or regions. Services, offers, and restaurant availability may vary by geographic market and rollout phase.

3. Account Registration and Eligibility

Users must provide accurate information during signup, including:

Full name

Email address

Phone number (primary account identifier)

Birth month and day (required for birthday offer eligibility)

Only one (1) account is permitted per unique phone number. Duplicate registrations, misleading information, or attempts to bypass eligibility controls may result in account restriction or removal.

Birth month and day are required for core platform functionality and cannot be edited after account creation.

4. Marketplace Display and Offer Discovery

The platform utilizes a structured marketplace that includes:

Featured quadrant placements (limited promotional visibility)

A “View More Offers” directory displaying all active offers within the applicable market

Consumers will only see active offers. Expired, capped, paused, or fully claimed promotions will not appear in active listings.

Display order, featured placement, and visibility rotation do not represent rankings, endorsements, or quality comparisons between restaurants.

5. Promotional Cycles and Redemption Limits

Restaurant offers operate on defined promotional cycles with fixed redemption capacity allocations. Once a restaurant reaches its redemption limit, its featured listing may be removed from active marketplace rotation to maintain fair visibility distribution.

Redemption limits apply equally regardless of whether a consumer discovers an offer through featured placements or the “View More Offers” directory.

6. Promotional Benefits and Offer Terms

Promotional offers and birthday-related incentives are limited-time promotional benefits. These benefits:

Have no cash value

Are not stored value products

Cannot be redeemed for cash

Future prepaid vouchers, if introduced, will retain the paid cash value in accordance with applicable laws and restaurant policies.

7. Payments and Restaurant Participation Plans

Restaurant participation plans are marketing and promotional placement services structured in promotional cycles with defined redemption capacity and rotational visibility.

Plans may be billed monthly, quarterly, or annually and activate immediately upon payment, initiating a new promotional cycle. Payments do not guarantee customer traffic, redemption volume, revenue, or continuous visibility.

Annual plans may provide eligibility for priority placement within designated quadrant slots, subject to availability, rotation policies, and platform balancing.

8. Rotational Visibility and Fair Exposure

Marketplace visibility is promotional and rotational in nature. Listings may change due to promotional cycles, redemption limits, participation tiers, and platform balancing mechanisms.

Removal from featured placement does not indicate negative performance, quality issues, or platform standing.

9. Account Integrity and Re-Registration

Users may request account deletion at any time. Re-registration after deletion may be subject to platform review to prevent misuse, duplicate accounts, or promotional abuse.

Birthday VIP Club™ reserves the right to restrict accounts that attempt to reset eligibility through duplicate registration or misleading birthday information.

10. Communications and SMS Consent

By registering, users agree to receive:

Transactional messages (offer delivery, confirmations)

Operational notifications (birthday reminders, platform updates)

Occasional promotional communications related to platform services

Message frequency varies. Message and data rates may apply.

11. Limitation of Guarantees

Offer availability at all times
